This policy explains which personal data we process when you visit modcodeplus.com or contact us, why we do it and what rights you have under the General Data Protection Regulation (GDPR).
1. Controller
The controller of your personal data is ModCodePlus Software, AI, Trade & Architecture Commitment, Export, Import, Consultancy Sp. z o.o., Augustyna Szamarzewskiego 21/2, 60-514 Poznań, Poland, entered in the National Court Register under KRS 0001199781. You can reach us at info@modcodeplus.com or +48 573 267 600. We have not appointed a data protection officer.
2. Data we process
- Contact form: your name, email address, phone number (optional), your message and the language version of the site you used.
- Emails and calls: the data you provide when you contact us directly.
- Server logs: when you open a page, the server automatically records technical data such as your IP address, date and time, the page requested and your browser type.
3. Purposes and legal bases
- Answering your inquiry and preparing an offer you ask for (Art. 6(1)(b) GDPR).
- Running the website securely and preventing misuse, our legitimate interest (Art. 6(1)(f) GDPR).
- Meeting legal obligations, for example tax and accounting rules once a contract is concluded (Art. 6(1)(c) GDPR).
4. Recipients
We do not sell your data or use it for advertising. It is processed on our behalf by: hosting provider TürkTicaret.Net (Türkiye) (website and server logs) and email provider TürkTicaret.Net (Türkiye) (contact form messages and email). Where needed, IT and accounting service providers also receive data, always under a data processing agreement.
5. Transfers outside the EU
Our hosting and email provider is currently located in Turkey, a country without an adequacy decision of the European Commission. The website, server logs and the messages you send us are therefore processed there. The transfer is based on Art. 49(1)(b) GDPR, because it is necessary to answer your enquiry and to take the pre-contractual steps you ask for. We plan to move hosting and email to Poland, after which this section will no longer apply.
6. No tracking
We use no analytics, advertising or social media tracking tools. Fonts and icons are served from our own server. Links to external sites (social media, Google Maps, Trustpilot) only send data to those services when you click them.
7. How long we keep data
- Inquiries that do not lead to a contract: up to 12 months after our last contact.
- Inquiries that lead to a contract: for the duration of the contract and as long as tax and accounting law requires (generally 5 years after the end of the year concerned).
- Server logs: for a limited period set by our hosting provider for security purposes.
8. Your rights
You have the right to access your data, to have it corrected or deleted, to restrict its processing, to data portability and to object to processing based on our legitimate interest. To exercise these rights, write to info@modcodeplus.com. You may also lodge a complaint with the President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland (uodo.gov.pl).
9. Is providing data required?
Providing your data is voluntary, but without your name, email address and message we cannot answer your inquiry. We do not use automated decision-making or profiling.
10. Changes
We update this policy when our processing changes. The date of the current version is shown at the top of this page.
